DAMPAK SEMA NOMOR 7 TAHUN 2014 TENTANG PENGAJUAN PENINJAUAN KEMBALI DALAM PERKARA PIDANA TERHADAP PUTUSAN MAHKAMAH KONSTITUSI NOMOR 34/PUU-XI/2013

Abstract

Supreme Court with any legal considerations have issued SEMA Number 7 of 2014 concerning Filing Petition for Judicial Review in Criminal Case, which states, that judicial review can only be done once unless there is an object case there are 2(two) or more conflicting reconsideration decision one with the other. The existence of SEMA Number 7 of 2014 is impacting the Constitutional Court, which will primarily be directly or indirectly eliminate the Constitutional Court. The controversy will lead to legal consequences that would need to be addressed and resolved by using instruments and a strong legal basis, namely legislation, both the revision of the Criminal Procedure Code or the law making a new criminal procedure law.
